Officer injured when man resists arrest

HARTINGTON – A Hartington man is facing a felony charge after assaulting an officer and causing him injury during his arrest.

Jose Cruz Estrada, 21, has been charged with felony assault on an officer, and resisting arrest and second degree criminal trespass, both misdemeanors.

Josh Bauermeister, a Cedar County sheriff’s deputy, was called to a Hartington business to the report that Cruz Estrada was harassing customers and refusing to leave. He also appeared to be intoxicated.

When Bauermeister attempted to arrest Cruz Estrada for trespassing, he resisted and a customer helped the officer in restraining him so the officer could handcuff him.

While walking to the patrol car, Cruz Estrada allegedly tripped Bauermeister, causing the officer to fall. He injured his right elbow and received seven stitches.

The officer physically forced Cruz Estrada into the patrol car.

Once at the Cedar County Jail, he continued to be uncontrollable so that jail staff could not go through the booking process.

Cruz Estrada was given time to cool down but he appeared to pass out and an ambulance was called and transported him to a Yankton, S.D., hospital.

After returning home from the hospital, Cruz Estrada was arrested and booked.

In a separate case, 33-year-old Chaz Dubrary, Norfolk, was also arrested on suspicion of resisting arrest.

Nebraska State Patrol officers were called to a vehicle parked on the shoulder of Highway 81 with the driver’s side door open, obstructing traffic.

Trooper Ryan Hilliard found Dubray to be driving under suspension. When Hilliard went to arrest him, Dubray resisted and it took another two officers to handcuff him and place him in the back of the patrol car.

Dubray has a previous conviction of resisting arrest, and is being charged with a felony in Cedar County, along with the misdemeanor of driving under suspension.

In other court news, a Laurel man is facing a felony charge for being in possession of firearms while prohibited.

Chad Young, 51, was arrested after the Nebraska State Patrol served a search warrant at his Laurel home and located 13 firearms with live rounds and explosives in the basement.

He told law enforcement the explosives are used to create fireworks.

Convicted of three previous drug-related felonies, Young is not allowed to be in possession of any firearms.
