Dan Thoene called the meeting to order. Present were Board Members Tom Pinkelman and Roger Becker. Also present was Diane Limoges, Village Clerk.

The floor was opened for discussion on the One and Six-Year plan submitted by Gilmore and Associates.

Tom Pinkelman made a motion to Armour Coat the last half block of East Second Street, the south half block of William Street between 1st and 2nd Street, and 4th Street from Nebraska Street to William Street as well as putting a second layer of Armour Coat on Ford Street between 2nd Street and 3rd Street as the One-Year Plan. Roger Becker seconded the motion. Voting for were Tom Pinkelman, Roger Becker, and Dan Thoene. No one voted against. Motion carried.

Roger Becker made a motion to connect the water main on William Street between 1st and 2nd Street as the Six-Year Plan. Voting for were Tom Pinkelman, Roger Becker, and Dan Thoene. No one voted against. Motion carried.

Tom Pinkelman made a motion to pass the One-and Six-Year Plan Resolution. Roger Becker seconded the motion. Voting for were Tom Pinkelman, Roger Becker, and Dan Thoene. No one voted against. Motion carried.

Roger Becker made a motion to adjourn. Tom Pinkelman seconded the motion. Motion carried.

Tom Pinkelman made a motion to accept the Minutes of the January 19th Regular meeting with the following correction: A bid will be collected for Armour Coating 4th Street between Nebraska and Williams Street rather than 3rd Street between Nebraska and Williams. Roger Becker seconded the motion. Motion carried.

Roger Becker made a motion to accept the Treasurers Report. Tom Pinkelman seconded the motion. Motion carried.

PUBLIC HEARING

REGARDING CHANGES TO LEWIS AND CLARK NATURAL RESOURCES DISTRICT MANAGEMENT AREA RULES AND REGULATIONS FOR GROUNDWATER MANAGEMENT AREAS

Pursuant to Nebraska Revised Statutes, § 46-701 et seq., the Lewis and Clark Natural Resources District (“LCNRD”) hereby provides notice that a public hearing shall be held on Thursday, March 19, 2015, at 1:00 p.m. in the LCNRD board room at 608 North Robinson Avenue, Hartington, Nebraska 68739. As required by law, the purpose of the hearing is to receive testimony and other evidence concerning the proposed changes to LCNRD Management Area rules and regulations. The geographic area effected by the changes to the proposed changes to the rules and regulations encompasses all lands within the LCNRD boundaries. A general description of the proposed regulations are as follows: (1) Amends the definition of terms; (2) Provides new procedures to obtain a permit to construct a replacement water well; (3) Amends well permit requirements for Dakota Class permits; (4) Amends variance permit requirements for three or more comingled wells; and (5) Amends groundwater transfer requirements.

Any interested person may appear at the hearing and present written or oral testimony concerning the proposed regulations. Individuals with disabilities may request auxiliary aids and service necessary for participation by contacting LCNRD by March 12, 2015. Testimony or other evidence relevant to the purposes of the hearing may also be submitted in writing to LCNRD at 608 N. Robinson Ave., Hartington, Nebraska 68739, by 5:00 p.m., March 18, 2015.

FINDINGS OF FACT

1. Nebraska Revised Statutes § 46-1101 – 1148, the Nebraska Chemigation Act, provides the authority for the adoption of rules and regulations to administer Chemigation. Statutes 46-701 – 754 the Nebraska Groundwater Management and Protection Act, also provides for rules and regulations that apply.

2. Notice of the February 19, 2015 Public Hearing on the proposed rules and regulations was published in accordance with state law in the following newspapers in general circulation in the Lewis and Clark NRD (LCNRD): (a.) Bloomfield Monitor.

3. Notice of the Public Hearing and a full copy of the proposed rule and regulations were posted on the LCNRD website atwww.lcnrd.org. Copies of the proposed rules and regulations were also made available from the LCNRD office in Hartington, Nebraska at the time of publication of the newspaper notices identified above.

4. The Public Hearing was held in accordance with state law and as noticed on February 19, 2015. All persons present at the Public Hearing were afforded an opportunity to provide oral or written testimony regarding the proposed rules and regulations.

5. The record of the Public Hearing was held open for the receipt of mailed, written testimony until the close of the Public Hearing. Copies of all written testimony, personally provided at the Public Hearing or mailed, were made available to the LCNRD Board of Directors for their consideration.

6. Testimony presented at the Public Hearing, whether written or oral, is part of the Public Hearing record on file with the LCNRD office in Hartington, Nebraska.

7. The LCNRD Board of Directors considered all testimony and, in open session, at its regular Board of Directors meeting on February 19, 2015, voted to approve the proposed rules and regulations.
