April 16, 2012

The meeting was called to order by Jesse Koch. Present were board members, Dan Thoene, Dave Rothluebber, and Chuck Kramer. Also present were Diane Limoges, Village Clerk, and Jerry Pollard, Village Attorney.
Dave Rothluebber made a motion to accept the minutes from the March 19th meeting. Chuck Kramer seconded the motion. Motion carried.
Chuck Kramer made a motion to accept the Treasures Report. Dan Thoene seconded the motion. Motion carried.

The bid from Maguire Iron to paint the water tower at a cost of $23,790.00 was reviewed. Chuck Kramer made a motion to accept the bid. Dave Rothluebber seconded the motion. Motion carried. The opening at the top of the leg will need to be addressed at the time of the painting. Maguire Iron will be contacted to address the problem with the understanding that there made be an additional charge for the repairs not stated in the bid.
Chuck Kramer made a motion to have Menford Electric hook up a water line from the hydrant to the shelter house in the park. Dave seconded the motion. Motion carried.
The bids for purchasing or leasing a 100 HP Tractor were reviewed. It was decided that the funds are not available at this time to warrant a different tractor. The loader tires will be replaced in lieu of a new tractor.
Road Guy will be contacted to get a bid for all of the streets not yet armour coated except for First Street as well as a quote to repair Omaha Street between First and Second Street.
Dick Wiebelhaus would like to place a curb and gutter, at his expense, on village property to direct water away from his house. The board saw no problem with project.
Stan Sudbeck will be contacted about the possible turning off of the water to the Reis property. This would be a safe guard to any water line breakage while the house sets empty.
A two week village wide clean up will once again take place. Art’s Garbage will be contacted to see how soon a roll away can be brought in.
Dave Rothluebber made a motion to adjourn. Chuck Kramer seconded the motion. Motion carried.

A public hearing was held by the Board of Education (the “Board”) of Cedar County School District 0008 (more commonly referred to as Hartington Public Schools) in the State of Nebraska (the “District”) at 5:00 p.m. on Monday, April 16, 2012, in Room #A-01 FCS at Hartington Public School, 501 S. Broadway, Hartington, Nebraska, being open to the attendance of the public and having been preceded by advance publicized notice, said advance publicized notice having been given in accordance with the provisions of Section 72-2301 et seq., Reissue Revised States of Nebraska, as amended (the “Act”), and the provisions of Article 14, Chapter 84, Reissue Revised Statutes of Nebraska, as amended (the “Open Meetings Act”), and having set forth (a) the time, date, and place of this hearing; (b) that this hearing would be open to the attendance of the public; (c) that an agenda of the subjects to be taken up at the hearing could be obtained form the office of the Superintendent of Schools (the “Superintendent”) (d) the District’s intent to adopt a bond measure authorizing an interlocal cooperative to issue bonds on behalf of the District in a principal amount not to exceed $100,000 (the “Bonds”) to finance the cost of any item of hardware or software used by the District in providing for the delivery of information, including the purchasing of upgrades or related improvement to information technology for the operation of libraries operated by the District (the “Project”) and levy a tax to pay the principal of and the interest on the Bonds and (e) the District’s intent to enter into an interlocal cooperation act agreement with one or more Nebraska public school districts and educational service units regarding the financing of the Project. Each Board Member was previously furnished with a copy of said advance publicized notice, the same having been transmitted to each Board Member simultaneously with its publicizing. A copy of the affidavit of publication of said advance publicized notice was ordered annexed to the minutes of the public hearing as Attachment 1. Additionally, reasonable efforts were made to provide advance notification of the meeting to all news media requesting the same of the time, date and place of the meeting.
The President of the Board, Jason Dendinger, presided, and the Secretary of the Board, Brenda Steiner, recorded the minutes of the hearing. On roll call the following Board Members were present: Jason Dendinger, Colin Kathol, Brenda Steiner, Gerri Jueden, Doug Miller. The following Board Members were absent: Ron Pearson. A quorum being present and the meeting duly commenced, the following proceedings were had and done.
The President of the Board publicly stated to all in attendance that a current copy of the Open Meetings Act was available for review and indicated the location of such copy in the room where the meeting was being held. All proceedings hereafter shown were taken while the meeting was open to the attendance of the public.
The President opened the public hearing as required by the Act in connection with the Project and the levying of a tax as provided in the Act. Notice of such public hearing was published in the Cedar County News, a legal newspaper of general circulation within the District, at least 10 days prior to the date hereof. The President then invited anyone present who was interested in expressing any position or opinion concerning the Project or the District entering into an interlocal cooperation act agreement to do so.

The following spoke in a neutral capacity: None.
After everyone desiring to do so was given an opportunity to speak, the President closed the public hearing.

Notice is hereby given that Cedar County School District 14-0008 (Hartington Public Schools) in the State of Nebraska (the “District”) has authorized a joint entity established pursuant to the Nebraska Interlocal Cooperation Act, Sections 13-801 et seq., Reissue Revised Statutes of Nebraska, as amended, to issue its General Obligation Technology Bonds, Series 2012 (the “Bonds”), pursuant to the Public Facilities Construction and Finance Act, Section 72 2301 et seq., Reissue Revised Statutes of Nebraska, as amended (the “Act”), in an aggregate principal amount not to exceed $100,000. The Bonds are being issued for the purpose of paying the costs of financing a “joint project” consisting of any item of hardware or software used in providing for the delivery of information, including the purchasing of upgrades or related improvements to information technology for the operation of libraries operated by the District. The principal of the Bonds is expected to be repaid no later than December 15, 2017, with a maximum principal payment of $100,000 due on such date. The maximum rate of interest payable on the Bonds is 5.00% per annum. A copy of the resolution authorizing the issuance of the Bonds may be examined during regular business hours at the Office of the Superintendent, 501 S. Broadway in Hartington, Nebraska for a period of at least 30 days following the date of publication of this notice.
